Terms of Service

Please read these Terms of Service ("Terms") carefully before using BrainPills. By accessing or using our neural interface technology and research program, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our service.

1. Acceptance of Terms

By creating an account, subscribing, or using any BrainPills service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

2.1 Neural Interface Technology

BrainPills provides access to a neural interface technology system ("Service") that allows participants to connect with AI systems through non-invasive EEG-based methods. The Service is designed for research and cognitive enhancement purposes.

2.2 Subscription Model

  • Access is provided on a monthly subscription basis
  • Three subscription tiers are available: Cortex, Cortex Pro, and Cortex Ultra
  • Subscriptions include access to the neural interface system, AI assistance, and research participation
  • Pricing is fixed for the duration of your subscription

2.3 Research Program

As a participant, you agree to participate in our ongoing research program. Your neural pattern data (anonymized) contributes to our research into brain-computer interfaces. See the Research Consent form for details.

3. Eligibility

  • You must be at least 18 years old to subscribe
  • You must be a healthy adult without neurological conditions or brain implants
  • You must not have any medical device that could be affected by neural interface technology
  • You must have the mental capacity to provide informed consent

We reserve the right to refuse service to anyone who does not meet these eligibility requirements.

4. Account Registration

4.1 Account Responsibilities

  • You must provide accurate, current, and complete information during registration
  • You are responsible for maintaining the security of your account credentials
  • You must notify us immediately of any unauthorized use of your account
  • You are solely responsible for all activity under your account

4.2 Account Termination

We may suspend or terminate your account if:

  • You violate these Terms
  • You provide inaccurate or fraudulent information
  • You use the service for unlawful purposes
  • You fail to maintain eligibility requirements

5. Subscription and Billing

5.1 Subscription Fees

Subscription fees are billed monthly in advance. Current pricing:

  • Cortex: $2,299/month
  • Cortex Pro: $3,999/month
  • Cortex Ultra: $6,999/month

We reserve the right to change pricing with 30 days' notice before your next billing cycle.

5.2 Payment

Payments are processed securely through Stripe, Inc. By providing payment information, you authorize us to charge the applicable fees to your payment method.

5.3 Cancellation

  • You may cancel your subscription at any time
  • Cancellation can be done through your account settings or by contacting orders@brainpills.ai
  • Upon cancellation, access continues until the end of your current billing period
  • No prorated refunds are provided for partial months

5.4 Refund Policy

All purchases are final. We do not offer refunds for any reason, including but not limited to:

  • Dissatisfaction with the service
  • Inability to achieve desired cognitive outcomes
  • Medical reasons (please consult a healthcare provider before subscribing)

We reserve the right to issue refunds in our sole discretion in exceptional circumstances.

6. Acceptable Use

You agree NOT to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe on the rights of others
  • Attempt to gain unauthorized access to other accounts or systems
  • Reverse engineer, decompile, or disassemble the Service
  • Use the Service for any harmful, illegal, or malicious purpose
  • Share your account credentials with others
  • Resell orCommercialize access to the Service without authorization

7. Research Participation

7.1 Voluntary Participation

Research participation is voluntary. You may withdraw at any time by contacting orders@brainpills.ai. Withdrawal does not affect your subscription - you may continue using the Service without research participation.

7.2 Data Use

Neural data collected is anonymized and used for research purposes. Individual data is never shared with third parties. Published research uses only aggregated, anonymous data.

7.3 Intellectual Property

By participating in research, you assign any rights to insights derived from your anonymized data. We retain all rights to improvements, discoveries, and innovations made through our research program.

8. Disclaimers

8.1 Experimental Nature

IMPORTANT: The BrainPills neural interface technology is experimental research. This is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or condition.

8.2 No Guarantees

  • We do not guarantee any specific cognitive outcomes
  • Results vary significantly by individual
  • We do not guarantee uninterrupted or error-free service
  • Service availability may be limited by infrastructure and research constraints

8.3 "As Is" Basis

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of Liability

9.1 Exclusion of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BrainPills SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, data, or business opportunities
  • Personal injury or property damage
  • Damage to devices or systems from using the Service
  • Any damages arising from reliance on the Service

9.2 Cap on Liability

OUR TOTAL LIABILITY SHALL NOT EXCEED THE TOTAL AMOUNT YOU HAVE PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9.3 Exceptions

THIS LIMITATION DOES NOT APPLY TO:

  • Our gross negligence or willful misconduct
  • Violation of your privacy rights
  • Our obligations under applicable law

10. Indemnification

You agree to indemnify, defend, and hold harmless BrainPills and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your violation of these Terms
  • Your use of the Service
  • Your research participation
  • Your provision of inaccurate information

11. Intellectual Property

11.1 Our Rights

All content, technology, software, and materials related to the Service are our intellectual property or that of our licensors. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

11.2 Trademarks

"BrainPills" and "Cortex" are trademarks. You may not use our trademarks without our written permission.

12. Third-Party Services

Our Service integrates with third-party services including:

  • Stripe (payment processing)
  • Microsoft Azure (cloud infrastructure)
  • SendGrid (email communications)

We are not responsible for third-party services. Their terms and privacy policies apply.

13. Force Majeure

We are not liable for any failure to perform due to causes beyond our reasonable control, including natural disasters, war, terrorism, riots, embargoes, acts of civil authorities, strikes, failures of third-party telecommunications, or infrastructure outages.

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms are governed by the laws of England and Wales, without regard to conflict of law principles.

14.2 Dispute Resolution

Any disputes arising from these Terms will be resolved through binding arbitration in London, England under the rules of the Chartered Institute of Arbitrators. Arbitration is final and binding.

14.3 Small Claims

Either party may bring claims in small claims court for matters within its jurisdiction.

15. Changes to These Terms

We may modify these Terms at any time. We will notify you of material changes via email at least 30 days before they take effect. Your continued use after changes take effect constitutes acceptance of the new Terms.

16. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

17. Entire Agreement

These Terms, together with our Privacy Policy and Research Consent form, constitute the entire agreement between you and us regarding the Service.
